#UGDecides: We respect SRC Judicial Board ruling despite dissatisfaction – Legal Counsel for EC

The Legal Counsel for the University of Ghana Students Representative Council (UGSRC) Electoral Commission, Kwabena Marfo says he was not pleased with the verdict from the SRC Judicial Board concerning the rerun of the just-ended elections.

Speaking on the Campus Exclusive show, Kwabena Marfo said he and his team was not pleased with the verdict because they believe it was based on speculation.

“We are not satisfied at all Even in the worst case scenario, a situation we could get to because in my opinion and in the opinion of the Counsel for the Respondent, the petition did not make any evidence at all to substantiate the claims they. The ruling was largely on speculations and we think it was something that was not right”

He further indicated that the Judicial Board did not provide enough evidence to show that the EC had done anything wrong, following the accusations at Mensah Sarbah Hall during the elections.

“Especially at Mensah Sarbah Hall, the ruling was to the effect that in the opinion of the court, the extension that lasted for about 2 hours could not adequately explain the number of voters that had voted after the extension. The ruling in no way implicate the EC in irregularities in the conduct of election,” he indicated.

“As students of the law, I think there is the need respect for the court. Even though we do not agree, I think the court has made its ruling and we need to respect that,” he added.

Meanwhile, Second Deputy Electoral Commissioner, Boaz Twumasi says that the Electoral Commission is yet to make preparations towards the rerun online elections.

Speaking on Campus Exclusive, Boaz Twumasi stated that the Electoral Commission and University of Ghana Computing System are yet to discuss on the specifics of the forthcoming elections.

“At the moment, the Electoral Commissioners haven’t sat on the issue. We are yet to sit on the issue. But as a matter of fact there is been an official directive from the outfit of the Chief Justice that we should use the online approach which means that we will have to go with UGCS. It is obvious that we would have to get in talks with UGCS.” he said.

The Judicial Board on Friday, December 10, 2021, ruled that an online election be organized by the University of Ghana Computing Systems after the court nullified the initial election results from the Mensah Sarbah Hall and Akuafo Hall following alleged irregularities.

The Judicial Boards Verdict

  1. Online election results cannot be said to be invalid as alleged by the 2nd Deputy UGSRC EC.
  2. Results for Mensah Sarbah Hall were declared null and void with the absence of proof of verification for the over 300 people who joined the queue to vote 14 minutes to the end of the polls.
  3. Discrepancies between the number of registered voters and verified voters hence result for Akuafo Hall Polling Station not acceptable.
  4. University of Ghana Computing Systems to handle the online elections for level 200 and 300 students of Mensah Sarbah Hall and Akuafo Hall in a week after the verdict.
  5. Handing over ceremony to be held five days after elections
