#UGDecides: Sacking us over contempt of court is mysterious – Fmr SRC 1st Deputy EC

Former first Deputy Electoral Commissioner for the University of Ghana Students’ Representative Council (UG SRC), Bright Siaw has described the termination of their appointment by the Judicial Board as mysterious.

According to him, the Board did not follow what he termed as procedures for removing Commissioners who conducted the 2021 SRC elections from office.

He made these comments after the three ECs were discharged from their respective roles for ‘willfully’ disobeying, violating court orders.

“Their so-called contempt does not necessitate sacking an Electoral Commissioner. Obviously, this is part of their scheme. It is a deliberate attempt to unconstitutionally remove the Electoral Commissioners from office for mysterious reasons which are only known by ‘JB'[Judicial Board]. What is their motive? I don’t know, this makes it mysterious,” He noted.

In his view, the Board was unfair and selective in sacking Electoral Commissioners on the basis of contempt of court orders.

Mr Siaw recollected the ruling of the Court in the case between Plaintiff Vanessa Nana Ofosua Okobour versus the acting SRC president, Nana Amo Ntow Fianko (1st defendant) and the acting SRC Legal Advisor, Nana Kwesi Pocco (2nd defendant).

In the seven-paged judgement, the Judicial Board cleared the acting SRC president to continue discharging his constitutionally mandated duties as the chief spokesperson of all students in the school and ordered the acting SRC General Secretary, Ruby Nkansah to constitute a General Assembly (GA) latest by July 27, 2021.

The latter directive was never complied with by the General Secretary even though Univers News learned that letters were sent for the purpose of collating the names of GA representatives of various Junior Common Rooms, departments, associations, unions and other appropriate bodies.

“You can’t just wake up and be sacking an electoral commissioner because of contempt. Then the A.g SRC President will not be president by now. When he was asked to form a General Assembly by the same Judicial Board, did he? What happened? Precedents will always come back to us,” He said.

The constitution of the University of Ghana Students’ Representative Council is clear on the removal of Electoral Commissioners from office.

Article 35 stipulates that “Any member of the Electoral Commission if he is found to be incompetent or otherwise unsuitable for the said office, he shall be removed from office by an order to that effect by the Judicial Board, which shall consider the case brought against the said officer”.
